Prosecutor: Boise Police Officer Justified in Feb. 2022 Officer-Involved Shooting

The Gem County Prosecuting Attorney’s Office determined that the actions of the Boise Police officer who shot and injured Jonathan Manee on Feb. 22, 2022, were justified under Idaho law.

The prosecutor reviewed the officer’s on-body video as well as the complete investigation conducted by the Ada County Critical Incident Task Force.

“We would like to thank the Ada County Critical Incident Task Force (CITF) led by the Ada County Sheriff’s Office and the Gem County Prosecutor for their thorough review of this incident,” said Boise Police Chief Ron Winegar.”

On February 22, 2022, a BPD officer was attempting to help a driver who was standing in the road near W. Fairview Ave and N. Liberty Street. Witnesses reported to dispatch that the driver was causing a traffic hazard and might need help.  Officer Cody Evans responded to the call, and pulled up behind the subject’s vehicle, which was stopped in the left turn lane on Fairview. The driver was standing by the passenger door waving and talking to passing drivers.  Shortly after arriving and contacting the subject, Jonathan Manee, Officer Evans changed the call type to Crisis due to the irrational statements Manee was making. Officer Evans attempted to escort Manee out of the roadway for his own safety, at which time Manee resisted, pulled a handgun out of his pocket, and pointed it at Officer Evans.

The Gem Country Prosecuting Attorney said that after reviewing Officer Evans’ body camera, the facts are not in dispute.

“While behaving abnormally in the roadway and within physical touching distance of Evans, Manee pulled a handgun out of his pocket and aimed it directly at Officer Evans. Evans responded by drawing his own weapon and firing at Manee twice, hitting him, and then immediately provided medical aid to Manee. The actions of Officer Evans were justifiable under Idaho law,” said Erick B. Thomson, Gem County Prosecuting Attorney.

Manee was treated and released from the hospital. He was charged with and convicted by a jury in June, 2023 of Aggravated Assault upon a law enforcement officer with a Deadly Weapon enhancement. On Monday, August 28, 2023, Manee was sentenced to serve up to 25 years in prison with 15 years fixed before being eligible for parole.
