City of Boise Free Wi-Fi - Terms of Use

I. Acceptance of Terms: The City of Boise, Idaho (“City”) offers wireless internet (“Wi-Fi”) access in the form of a guest Wi-Fi network (“Service”) on or in select City areas and buildings free of charge. By accessing and using the Service, the user (“You”) agrees to abide by these Terms of Use ("Terms"). If You do not agree to these Terms, please refrain from using the Service.
II. Disclaimer: THE SERVICE IS PROVIDED ON AN "AS IS" BASIS, AND YOUR USE THEREOF IS AT YOUR OWN RISK. THE CITY DOES NOT MAKE AND HEREBY DISCLAIMS, ANY AND ALL OTHER EXPRESS AND IMPLIED WARRANTIES OR CONDITIONS, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT AND TITLE, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. THE CITY DOES NOT WARRANT THAT THE SERVICE WILL PERFORM AT A PARTICULAR SPEED, OR WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
III. Security And Assumption of Risk: The Service is unencrypted and unfiltered. Use of the Service is done at Your own risk. It is strongly recommended that you do not use the Service to transmit personal, financial, or legal data. It is not possible for the City to protect you against malicious theft or interception of such data transmitted over the City’s Service. For that reason, You expressly agree that You knowingly assume such risk, and further agree to hold the City harmless from any claim or loss arising out of, or related to, any such instance of hacking or other unauthorized use or access into Your computer.
IV. Use of Service and Prohibited Activities: The Service is provided solely for lawful purposes. You agree to use the Service in compliance with all applicable laws and regulations. Failure to comply with these terms and conditions may lead to loss of Service access, suspension of privileges, and prosecution or civil liability. You agree not to use the Service for the following prohibited activities:
1. To upload, download, display, perform, transmit, or otherwise distribute any content that:
- is libelous, defamatory, obscene, pornographic, abusive, or threatening,
- advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or foreign law or regulation,
- advertises or otherwise solicits funds or is a solicitation for goods or services,
- infringes, violates, or misappropriates the intellectual property rights of others, or
- is spamming or an invasion of privacy of another.
2. Accessing illegally or without authorization computers, accounts, equipment, or networks belonging to another party, or attempting to penetrate/circumvent security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans, or other information-gathering activity.
3. The transfer of technology, software, or other materials in violation of applicable export laws and regulations.
4. Using the Service in violation of applicable law and regulation, including, but not limited to, advertising, transmitting, making available ponzi schemes or pyramid schemes, fraudulently charging credit cards, pirating software, or making fraudulent offers to sell or buy products, items, or services.
5. High bandwidth operations, such as large file transfers and media sharing with peer-to-peer programs (e.g., torrents).
6. Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
7. The sale, transfer, or rental of the Service to customers, clients, or other third parties, either directly or as part of a service or product created for resale.
8. Seeking information on passwords or data belonging to another.
9. Intercepting or examining the content of messages, files, or communications in transit on a data network.
10. Making unauthorized copies of proprietary software or offering unauthorized copies of proprietary software to others.
11. Hacking.
12. Distribution of internet viruses, worms, trojan horses, pinging, flooding, mail-bombing, or other destructive activities, or distributing information regarding the creation thereof.
13. Any activities that disrupt the use of or interfere with the ability of others to effectively use the Service.
V. Content Filtering: The City may implement content filtering measures to block access to certain websites or content deemed inappropriate or harmful. By using the Service, you agree to such filtering measures.
VI. Privacy: The City may collect certain information about your use of the Service, including but not limited to your IP address, device information, and browsing activity. This information may be used for purposes such as improving the Service, analyzing usage trends, and enforcing these Terms. By using the Service, you consent to the collection and use of your information as described herein.
VII. Indemnity: By using the Service, you may be accessing the Internet which is a public communications network. You assume full responsibility and risk for accessing the Internet through the Service and You hereby expressly acknowledge and agree that there are significant security, privacy, and confidentiality risks inherent in accessing or transmitting information through the Internet, whether the connection is facilitated through wired or wireless technology. Accordingly, you agree that the City is not liable for any interception or transmissions, computer worms or viruses, loss of data, file corruption, hacking, downloading of malware, or damage to your computer or other devices that result from the transmission or download of information or materials through the Service. Further, You are solely responsible for evaluating the accuracy, completeness, and usefulness of all information, products, and services, and the quality and merchantability of all merchandise on the Internet accessed through the Service.
VIII. Modifications: The City reserves the right to modify or terminate the Service or these Terms at any time, with or without notice. It is your responsibility to review these Terms periodically for any changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
IX. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Idaho and ordinances of the City of Boise. In the event of a dispute, the venue shall be in the courts in Ada County, Idaho.
X. Severability: If any provision of this Agreement is held to be unenforceable or illegal, the other provisions shall continue in full force and effect.
