Purpose

The purpose of this regulation is to establish clear requirements for the employment of individuals under the age of 18 by the city. This regulation ensures compliance with all applicable federal and state labor laws while supporting safe, appropriate, and beneficial work opportunities for minor employees. 

Statement

The city is committed to providing meaningful employment opportunities for minors while safeguarding their health, safety, education, and well-being. Employment of minors shall be conducted in strict compliance with applicable laws and the standards set forth in this regulation.

Scope

This regulation applies to all city departments and governs the employment, scheduling, and work assignments of individuals under the age of 18. It applies to all positions in which a minor may be employed and includes limitations based on age, job duties, and work hours.

Definitions

1. Minor: 
An individual under the age of 18.

2. Non-hazardous Jobs: 
Work that does not involve activities or equipment deemed hazardous under applicable child labor laws, including but not limited to the following:

A. Office and clerical work, including operation of office machines.

B. Merchandise-related tasks such as stocking shelves, cashiering, selling, price marking, assembling orders, packing, shelving, and filling customer orders.

C. Errand and delivery work performed by foot, bicycle, or public transportation.

D. Indoor and outdoor cleanup work, including emptying trash, mopping, vacuuming, and waxing floors, excluding the use of power-driven mowers, cutters, trimmers, edgers, or similar equipment.

E. Intellectual or artistically creative occupations such as computer programming, software writing, teaching, tutoring, peer counseling, teacher’s assistant roles, singing, music, and art.

F. Limited kitchen work involving preparation of food and beverages.

G. Limited cooking duties that do not involve open flames; deep fryers must be equipped with and utilize devices that automatically lower and raise baskets into hot oil or grease.

H. Properly certified 15-year-olds working as lifeguards or swim instructors at traditional pools and water park facilities, excluding elevated areas of power-driven water slides.

Responsibilities

1. Departments:  
Ensure compliance with this regulation when recruiting, hiring, scheduling, and supervising minor employees.

2. Supervisors and Manager 
Assign only age-appropriate, non-hazardous duties to minor employees and ensure work schedules comply with all hour and time-of-day restrictions.

3. Human Resources: 
Provide guidance on applicable laws and verify compliance with employment eligibility and age-related requirements.

Employment of Minors

Minors Younger Than Age 14

Departments shall not hire individuals younger than 14 years of age for any position.

Minors Aged 14 and 15

1. May be employed only in non-hazardous jobs.

2. May work only outside of school hours.

3. When school is in session, may work up to three (3) hours per day and no more than eighteen (18) hours per week.

4. When school is not in session, including school breaks, may work up to eight (8) hours per day and no more than forty (40) hours per week.

5. May work only between the hours of 7:00 a.m. and 7:00 p.m., except from June 1 through Labor Day, when evening hours may be extended until 9:00 p.m.

Minors Aged 16 and 17

1. Are prohibited from driving motor vehicles, serving as outside helpers on motor vehicles on any public road or highway, or operating motor vehicles on any public road or highway.

2. When attending school, may not work beyond 9:00 p.m. on school days.

3. During school breaks, may work scheduled shifts of up to eight (8) hours per day and no more than forty (40) hours per week.
