City Settles Federal Lawsuit

BOISE - The City of Boise has settled a federal lawsuit challenging the constitutionality of a city ordinance.

Luke Schuchardt filed a lawsuit against the city in January 2024 contesting the city’s loitering ordinance (5-2-3(A)(2)) following his arrest and prosecution after being stopped and questioned by Boise Police officers. A federal judge found the ordinance to be unconstitutional as written.

The $200,000 settlement was reached after both parties evaluated the merits of the case and the resources required for extensive litigation.

As part of the settlement, the City Council will take up a repeal of the ordinance, which has been suspended by executive action since the judge’s ruling.
