Legal Non-Conforming Use
A legal nonconforming parcel, structure, use, sign, or site feature is one that was legally established but that is not in compliance with the current code due to a subsequent ordinance amendment, annexation, change of zoning, eminent domain, or similar action and not due to the actions of the property owner.
For structures that existed prior to the original zoning code (1966) the applicant must:
- Prove the use/structure existed prior to 1966
- Prove it was in continuous use from inception to current
